False Price-off promotions of an E-commerce Company to be Sentenced to Triple Compensation
The "11.11" activity was preheated in online "live streaming chat rooms" a few days ago, which enabled the public to feel the influence of online shopping once again. Every year at midnight on November 11, tens of millions of netizens surf shopping websites to wait the launch of “11.11" activity, which is comparable to the New Year's Eve.
However, an e-commerce company received a triple fine by the court for raising the original price of the goods, offering false price-off promotions and misleading consumers.
Ms. Li, a senior enthusiast for online shopping, saw on the Internet that cosmetics that had been advertised before were being promoted lately. The expressions "annual promotion" and "the lowest price in history" successfully attracted her attention. The e-commerce company discounted the Essence of 1,500 yuan to 618 yuan and the Liquid Foundation of 926 yuan to 329 yuan and gave 20% discount for 4 pieces. Ms. Li got a hot head and bought products of 1,894 yuan, which ultimately was 1,515.2 yuan after the discount.
After the arrival of products, Ms. Li believed the effect was unsatisfactory after using them. She wondered why products with low quality was so expensive. Consequently, she looked through the sales records of those products and found that the lowest transaction price of the Essence was 450 yuan and that of the Liquid Foundation was 249 yuan. The so-called commodities in "the lowest price in history" charged dozens of yuan more than the usual price! Moreover, the marked prices of 1500 yuan and 926 yuan were not the original prices of goods, but the prices arbitrarily marked by the e-commerce company.
Ms. Li suddenly realized that she had been deceived by false marketing, so she reported the e-commerce company for false price-off promotion to the Bureau of Commodity Price. After investigation, the Bureau of Commodity Price determined that the price-off promotion of the e-commerce company for cosmetics constituted a price violation and imposed administrative penalties on it. Later, Ms. Li sued the e-commerce company to the court, and the e-commerce company was sentenced to triple compensation, namely 4,545.6 yuan.
