我希望大家喜欢看到这些

先前课程中可能展示过的材料

我想做的就是重新强调

为什么土地整备是现有方法里面

最为可行的一种

主要有三个原因

第一 土地整备是为了保护社区结构

避免城市绅士化

正如我在前几节中提到的那样

土地整备实际上是为了交换土地

或者交换产权

在重建场景下

现有的居民不会因为土地征用

而丧失其所有权或者被赶出去

在社区重新规划 重新建设

以及基础设施到位后

他们将回到现在的社区

这与现行的强制购买

或市场交易形成了鲜明对比

因为在这两种方法中现有居民都必须离开

他们失去了 享受城市重建

带来的再发展效益的机会

第二 土地整备试图创造一个双赢的局面

在很多情形下

开发人员利用一个或多个空壳公司

从现有居民手中获取资产

现在这可能会起作用 也可能不起作用

如果这种方法不起作用 而且社区发现

这家公司使用空壳公司来获取所有权

那么他们将失去所有开发商的信任

下一次 开发商想与居民合作

将会变得非常非常困难

最重要的是 除了少数开发商之外

开发商还承担着

获取大部分土地所有权的风险

我们将其称之为抵制

如果现有的一两个居民拒绝出售

那么开发商就有可能

失去全面开发整个社区的能力

这可能会给开发商造成

大量的时间和金钱损失

第三 与传统方法不同的是

我们认为土地整备不仅仅

是一种征用土地的方法

还是一种让居民们

学会如何掌管社区事务

尤其是重新开发方面事物的机制或机会

正如我们在上一节所提到的

土地整备需要所有利益相关者之间

进行高度协调与合作

在一个功能性良好的民间社会里

我们需要所有利益相关者共同努力

土地整备为他们提供了绝佳的机会

来表达他们的担忧

向项目方提供意见

并就如何升级或改善他们的社区做出决策

无论是责任方面 还是权利方面

这对我们学习如何成为一名公民

都是个非常重要的机会

明确说来 土地整备并不是

解决土地征用问题的万金油

事实上 土地整备也有其弊端

主要有两大弊端

第一 由于土地整备需要土地所有者

和其他利益相关方之间高度协调和合作

有时需要很长时间

才能启动 设计并实施

土地整备项目

因此 所有利益相关者都必须对该项目

做出郑重承诺 以使该项目能按计划实施

他们若不这样做

就很难以互利有效的方式完成项目

第二 土地整备是一种

不是很适合当今

产权思维的方法

正如我们在前几节中提到的

土地调整运行中最重要的就是

说服土地所有者暂时放弃土地

将土地交与发起人 并允许他们征集土地

然后重新规划土地并用于基础设施建设

经过这些操作后 土地将归还给

现有的土地所有者

当今世界 由于宪法条款

强调保护私有财产权

所以很难说服土地所有者

放弃这块土地

即便是暂时为了整个社区的利益

在当今的经济形势下 我们的想法就是

首先要保护自己的利益

因此 土地整备需要大量说服工作和努力

来改变人们的心态

以使土地整备在当今经济形势下发挥作用

总之 如同所有的方法一样

土地整备也有其利弊

土地整备能够保护社区

避免城市绅士化

帮助开发商减少土地征用的风险

同时也为公民创造了机会

使得他们在决定公共政策方面

特别是与其家园和社区相关的政策上

了解自己的权利和责任

土地整备的缺陷就是

它需要大量的时间和耐心

此外 土地整备的想法

与现有的私有财产权背景并不完全吻合

因此对于发起人来说 这需要很多时间

和耐心来改变参与各方的心态

从而开展土地整备工作

现在 在以下几个模块中

我们将为大家继续强调

而且我们还将向大家展示 在现实世界中
