Myth #2: Clearly Delineated Property Rights

There have been rigorous debates about the need for clearly delineated property rights to implement land readjustment.  On one hand, proponents argue for establishing a clear property right regime prior to any adoption of land readjustment, because it involves the swapping of property.  Without formal knowledge or records of who owns what, land readjustment would be very difficult to implement.  On the other hand, opponents argue that property relations in most developing countries are not clearly defined.  It would take a long time and tremendous effort to clarify property relations, especially in situations where informality dominates.  In other words, a legal titling requirement could make land readjustment of little use in some developing countries.  The video below presents both arguments based on land readjustment experiences in selected developing countries. 

对于实行土地整备时，是否需要清晰的产权划分，已经有了严谨的辩论。一方面，支持者认为，实行土地整备前，应当建立清晰的产权制度，因为土地整备涉及土地置换。如果对产权所属没有清晰的了解或记录，将难以实行土地整备。另一方面，反对者认为，大多数发展中国家产权关系不明确， 需要耗费很长的时间和精力来明晰产权关系，尤其是非正式居住占据主导的情况下。换言之，在某些发展中国家，要求法律赋予所有权可能会使土地整备收效甚微。以下视频选取了部分发展中国家，根据它们土地整备的经验展现了这两种观点。
