REGULATOR

The regulator works at the state level. The regulator was not informed about the initial development plans when the developer “sidestepped” traditional environmental reviews by announcing that the “first phase” of the project would remain below the geographic scale and impact thresholds specified in the relevant state laws.  However, the regulator was brought in when the federal government (which doesn’t usually get involved in local land use regulation) issued statements of concern in the face of national notoriety caused by media coverage. The state regulator now wants to ensure that the development proceeds in compliance with a strict interpretation of all federal, state, and local requirements. The regulator also needs to defend the state government against charges that the country has “lax” regulatory standards. Sometimes multiple agencies have regulatory oversight of large projects.  They often get together to choose a lead agency to sit at the table with other stakeholders.
